About Open Work Permits

Under the immigration rule of Canada, even the spouses of temporary foreign individuals require an open work permit to work in Canada. Pilot Program

Since 20174 December, there has been an introduction to the pilot program by the government. Here the concerned authorities provide allowance to the spouses and the common-law partners to work in Canada. But the process is slightly different. It isn’t a typical job-oriented work permit. Here these people are sponsored under the family class sponsorship category. They would receive the open work permit only when the permanent residence application is in process. In such circumstances, there is no requirement for an appointment letter.

The open work permit holder can work under any Canadian employer. But you do not need any confirmed appointment letter as it is not a job-specific work permit.

Eligibility Criteria

For the open work permit, one needs to fulfill the following eligibility criteria:

  • The primary temporary international employee’s employment follows NOC rules with levels 0, or A or B. There is no requirement of skill level here if nominated by PR by the provincial nominees.
  • The primary temporary international employee can receive a Canadian work permit for at least six months. But for open work permit eligibility, the spouse or common-law partner of the international student can’t be another full-time student. The international student needs to be attending a full-time degree course or diploma at a publicly-funded post-secondary educational institution.

Apart from that, the student can also be a graduate and have an appropriate work permit for employment in Canada. The spouses and partners get the licenses with a specific expiry date, which would match their spouses’ allowance to work or study in Canada.
